Divorce and Health Insurance: What Changes?

Coverage may change

Whether spouse or dependent coverage ends, and when, depends on the health plan and the qualifying event. Check the plan administrator and the plan's Summary Plan Description rather than relying on a general article. This website does not determine whether coverage will end, whether a particular option is available for your situation, or what deadline applies.

COBRA may apply to qualifying group plans

The U.S. Department of Labor explains that divorce or legal separation can be a qualifying event for eligible spouses, former spouses, and dependent children under covered group health plans. The Department of Labor also explains that continuation coverage after divorce or legal separation can last up to 36 months for eligible qualified beneficiaries. COBRA does not apply to every plan or every person. Eligibility depends on the plan and circumstances. Confirm directly with the plan administrator or an official source.

Covered California and Medi-Cal

Covered California lists qualifying life events and special enrollment information, including certain coverage losses and household changes. Do not assume divorce or legal separation automatically creates a special enrollment period in every circumstance; check the current Covered California rules. Medi-Cal can be applied for through official state channels, subject to current eligibility rules. This site does not calculate Medi-Cal eligibility.
